These Terms & Conditions (“Terms”) govern your use of the WombVibe mobile application, website at https://www.wombvibe.com, and related services (together, the “Service”) operated by WombVibe (“we”, “us”, or “our”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
WombVibe is designed for adults who are pregnant, postpartum, or supporting a pregnancy journey. You must be at least 16 years old to create an account. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian. By using the Service, you confirm that you meet these requirements and that the information you provide is accurate.
2. Description of the Service
WombVibe provides wellness content and tools for pregnancy and early parenthood, including:
- Music, soundscapes, sound mixing, and offline listening
- AI Comfort — mood-based music suggestions based on text you enter
- Weekly journey content, nutrition and exercise guides
- Care tools such as kick counter, contraction timer, symptom log, weight tracker, and appointment reminders
- Postpartum features including mood check-ins, baby tracking, and recovery support
Features may change, be added, or be removed over time. We may offer free and paid tiers; availability of specific features may depend on your subscription status.
3. Not medical advice
WombVibe is a wellness app, not a medical device, and does not provide medical advice, diagnosis, or treatment. All content — including music, guides, AI-generated suggestions, and care tools — is for general informational and personal tracking purposes only.
Tools such as the kick counter, contraction timer, symptom log, and weight tracker are aids for your own records. They do not replace professional prenatal, obstetric, or pediatric care. Always consult your midwife, doctor, or another qualified healthcare provider about your health and your baby's health. In an emergency, contact local emergency services immediately.
4. Accounts and security
You may sign in using email, Apple Sign-In, or Google Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at support@wombvibe.com if you suspect unauthorized access.
Some data may be stored locally on your device. When you sign in, selected data may sync to your account so you can access it across devices.
5. Subscriptions and payments
Certain features require a paid purchase or subscription. Payments are processed by the Apple App Store, Google Play, or other authorized payment platforms — not directly by us. Pricing, billing cycles, free trials, and refund policies are governed by the applicable store's terms.
Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions in your device's store settings. Lifetime or one-time purchases, where offered, are subject to the store's refund rules.
We use RevenueCat to manage entitlements and purchase status. RevenueCat receives transaction identifiers and subscription status — not your full payment card details.
6. Your content
You retain ownership of content you create in the app, including mood entries, notes, symptom logs, saved mixes, and other personal records (“User Content”). You grant us a limited, non-exclusive licence to host, store, process, and display User Content solely to operate and improve the Service — for example, to sync your data, build an AI Comfort playlist from text you type, or generate a PDF export for your own use.
You represent that your User Content does not violate any law or third-party rights. We may remove content that violates these Terms or applicable law.
7. Intellectual property
The Service, including all music, audio, artwork, branding, software, and written content (excluding your User Content), is owned by or licensed to WombVibe. You receive a limited, personal, non-commercial, non-transferable licence to use the Service as intended. You may not copy, redistribute, resell, publicly perform, reverse-engineer, or create derivative works from our content except as expressly permitted.
8. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Scrape, crawl, or bulk-download content from the Service
- Interfere with or disrupt the Service or its infrastructure
- Misrepresent your identity or affiliation
- Share account credentials or resell access to paid features
We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users.
9. Third-party services
The Service integrates with third-party providers including Google Firebase (hosting, authentication, and analytics), Apple and Google (sign-in and payments), and RevenueCat (subscription management). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services we do not control.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WOMBVIBE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
12. Termination
You may stop using the Service at any time. You may request account deletion by contacting support@wombvibe.com or through in-app settings where available. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) will survive.
13. Changes to these Terms
We may update these Terms from time to time. We will post the revised version on this page and update the “Last updated” date. Material changes may also be communicated through the app or by email where appropriate. Continued use after changes take effect constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws applicable in the jurisdiction where WombVibe operates, without regard to conflict-of-law principles. Any dispute shall be resolved in the courts of that jurisdiction, unless mandatory consumer protection laws in your country require otherwise.
